The patent for the original light stick was give to Theodore in the late 60's. In 2018, Participation Designs joined with University of Texas, Dallas through a Capstone Engineering student program to update the designs with new technology. Participation Designs has submitted the new patent for the updated designs. The US Library of Congress has acknowledged and the updated patent is pending.

Participation Designs, also has three additional Trademarks pending for the updated designs. They anticipate that all should be approved prior to the launch of the first light in the 4th quarter of 2021.
